Abstract

This paper aims at studying the meaning of liberties within Ortega’s thought and works. The interest of this topic is based upon the fact that José Ortega y Gasset is regarded as one of the most genuine and solid representatives of Spanish Liberalism. Taking into account that liberties have a continuous reference in Ortega’s works, this paper will not attempt to cover every one of them. No complete list of quotations related to rights and liberties have been tried to be displayed. No quantitative census of terminological references has been elaborated. Instead, I have preferred to lay out a qualitative approach to the rationalvitalistic concept of rights, which derives both from explicit references and implicit thesis.

Author Biography

Antonio Pérez Luño, Universidad de Sevilla

Professor of Philosophy of Law and Chair of the Department of Philosophy of Law at the University of Seville. He holds a Ph.D. in Law from the University of Bologna, has been a fellow at the Max Planck Institute in Heidelberg, and has also studied at the universities of Coimbra, Trieste, Freiburg im Breisgau, and Strasbourg. Among his major works are Lessons in Philosophy of Law (1983), Human Rights, the Rule of Law, and the Constitution (1984), Fundamental Rights (1984), Legal Certainty (1991), and The Debate on the New World. The Spanish Classics of the Philosophy of Law (1992), a work translated into German under the title Die klassische spanische Naturrechtslehre (1994), Cybercitizen or Citizen.com? (2004), Dimensions of Equality (2005), and The Third Generation of Human Rights (2006).
